And no, the Trail of Tears wasn't genocide. Are you really a teacher? Genocide is the systematic extermination of a race, religion, or ethnicity. MOVING people from land is not genocide. You see, genocide, Nazi, war crimes, racist, these terms shouldn't be thrown around willy nilly. They have meanings. Genocide has a definition and we ought to remember that. I believe America has faults too; I just don't blame her for EVERYTHING, including things that haven't even happened and are blatant lies.

I admit we were wrong when we have been wronged, but I'm not about to blame my country for "genocide" because of friction between us and a multitude of tribes over the course of hundreds of years. Saying we wronged Natives is like saying we wronged Europeans. We did, but which ones? They're not a big group. They have their own identities. Some were wronged, some weren't, and some got what they had coming. Why can't you admit that many of them wronged us?

Much was the result of Indian actions. In fact, we were at peace with Indians for a time after the French and Indian War until certain Indians launched a terroristic race war in the form of Pontiac's Rebellion. We wanted to settle land and open trade routes in the West, and Pontiac wanted to wipe us out and push us into the seas. It's all well and good to point to the victors and blame them for winning, but try looking at history in context and you'll see it's not as simple as genocide.

Thank God Jackson stood up to John Marshall. Andrew Jackson believed in upholding the Constitution and opposed the idea of the Supreme Court having power over the other branches. The Indian Removal Act and the treaties and agreements made by the Legislature and President with Native tribes were none of the Court's business. They had no place telling Jackson what to do. "John Marshall has made his decision now let him enforce it." Judicial Review lost and the separation of powers was upheld.

I don't agree with anything you're saying, but I like you. You're not making this personal. It's purely philosophical. As for Andrew Jackson-he was often referred to as King Andrew. Granted,he ushered in the era of the common man,but what if Ike had done the same when the court voted on Brown? The Cherokee had done everyting to assimilate, created a written language, become farmers, owned slaves...it made no difference. They didn't matter as much as their land did.

I guess I was wrong about this not being personal. I missed a post. Yes, I am a teacher. And I don't subsribe to the Webster definition of genocide. I believe slavery in this country was a farm of genocide. Did American intentionally exterminate Africans? No, but the system under which they lived killed many of them and those that surved were damaged for generations. Anyway, I'm done with this conversation. You believe what you believe and I believe somethign different. God Bless America!!

You really ought to investigate more. Andrew Jackson was called King Andrew by his political enemies like Henry Clay because he refused to support the Bank of the United States which he thought to be and unconstitutional institution.
Aha, as for Brown, it's interesting. Little known fact is that segregation wouldn't have been an issue if the Supreme Court hadn't before upheld it as constitutional rather than a violation of the 14th Amendment. The Court is run by men in robes, not gods.

So you can say the Court got it right in Brown vs. Board and use it as an example in support of judicial review, but then you'd have to ignore that judicial review was used by the Supreme Court in Plessy vs. Ferguson to uphold segregation as constitutional in the first place which set the precident for continued discrimination. So all you can really say is they got it wrong the first time but right the second, which isn't a very good case. Judicial review made the problem in the first place.

No, I believe slavery was just what it was- slavery. Nothing less, but nothing more. Slavery had been a universal institution practiced by every people in ever corner of the world. Africans had it. The Chinese and Natives had it (long before meeting the white man). The Muslims and Arabs had it. There was no extermination of them. Have no doubt that they suffered greatly. Brutal conditions and harsh treatment but at the end of the day they were not wiped out and had populations larger than whites

Okay, last comment...granted the court got it wrong in 1896 with Plessy, but it was 1896! I'm not saying the court is infallible. However, I believe Chief Justice Marshall had it right and Andrew Jackson had it wrong. As for slavery, yes Africans had it, but with nowhere near the brutality practiced by Europeans. Slaves brought to the sugar cane fields of American lived an average of three years after arrival.I guess three years is better than two.

All revisionist historians have the same line "the white man didn't invent slavery." They didn't, but they perfected it. And last comment about judicial review..The supreme court you hate has recently ruled in favor of gun owners. Do you want to ignore those rulings because it's not their place? Yes, 58 years before. But the point was that the Court isn't a source of wisdom or social justice. The Constitution has limits on the third branch, and just because you agreed with Marshall is no reason to toss out the other branches. I can point to cases where I think the courts were right but I still think the use of judicial review is unconstitutional and would never support it knowing they'd side with me.

Giving them the power to legislate from the bench will enslave us all one day when five men in black cloth decide the Constitution says something it doesn't, just as they tossed Dred Scott into bondage. And Jackson was right by the way. If he hadn't moved them, the Georgian militia would have exterminated them and taken the land by force. That'd have been a real genocide. Jackson actually averted a bloodbath. Many died on the trail, but they weren't wiped out like they would have been.

Actually I'd say the North Koreans or Cubans have the perfect form of slavery today. There's slavery in Africa today much more brutal than that of the South. I'm not defending the South or the Union in any way when it comes to slavery by the way. Slavery was a moral evil and a crime that thankfully was resolved over time without completely ruining the Union. But again, I can't defend slavery, but it wasn't genocide. If we can define slavery as genocide then why not war itself? Disease? Hunger?
